Terms of Use — Home Inspection AI

1. Overview

These Terms of Use (“Terms”) govern your use of the Home Inspection AI app and related services provided by Thomas Enevoldsen / XBuildStudio (“we”, “us”, “our”). By using the app, you agree to these Terms.

2. Service description

Home Inspection AI allows you to upload or capture photos and generate visual previews of changes using AI. Results are for informational and illustrative purposes only and are not professional advice.

3. Eligibility

You must be at least 4 years old.

4. License and restrictions

We grant you a limited, non‑exclusive, non‑transferable, revocable license to use the app for personal, non‑commercial purposes. You agree not to:

  • Reverse engineer, modify, or create derivative works of the app.
  • Use the app for unlawful, infringing, harmful, or abusive purposes.
  • Upload content that is illegal, offensive, or violates third‑party rights.
  • Attempt to bypass technical protections, rate limits, or usage controls.

5. User content and ownership

You retain ownership of your photos and any content you submit. By submitting content, you grant us a limited license to process and transmit that content solely to provide the app’s functionality. We do not use your content to train models or for marketing.

6. In‑app purchases and subscriptions

Auto‑renewable subscription (Pro) — Price and billing period are shown in‑app. Payment is charged to your Apple ID at confirmation of purchase. Subscription renews automatically unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. Manage or cancel your subscription in your Apple ID settings.

Consumable purchases (Credits) — Credits enable additional renders. Credits are consumed upon use and are non‑refundable once delivered, except as required by law or Apple’s policies.

Free tier — We may offer a limited number of free renders per period; limits and features may change.

Refunds — All billing is handled by Apple. Refunds are subject to Apple’s policies. We do not process refunds directly.

Changes — We may change pricing, features, or availability. If we materially change the service, we will take reasonable steps to notify you.

7. Advertising

Non‑Pro users may see ads provided by Google Mobile Ads (AdMob). In EEA/UK, we present a consent prompt via Google’s User Messaging Platform. If you do not consent, you will receive non‑personalized ads. Ads may reference third‑party content; we are not responsible for third‑party websites or services.

8. Availability and modifications

We aim to keep the app available but do not guarantee uninterrupted or error‑free operation. We may modify, suspend, or discontinue features at any time. We are not liable for any loss resulting from such changes.

9. Disclaimers

The app and results are provided “as is” and “as available” without warranties of any kind. We disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy of results, and non‑infringement.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the app. Our total liability for any claim shall not exceed the amount you paid to us for the app or services in the 12 months preceding the claim, or the minimum amount allowed by law.

11. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your misuse of the app or violation of these Terms.

12. Termination

We may suspend or terminate your access if you violate these Terms or misuse the service. You may stop using the app at any time. Termination does not entitle you to refunds, except as required by Apple or law.

13. Governing law

These Terms are governed by the laws of Denmark, without regard to conflict of law rules. Courts in Copenhagen, Denmark shall have exclusive jurisdiction, unless mandatory consumer protection rules provide otherwise.

14. Changes to these Terms

We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.
